Required Documents for China Patent Application
There are THREE types of patents in China, specifically, invention, utility model and design, which requires different documents for the filling, besides ID or business license copies of the applicant and the creator both in English and Chinese.
A design patent refers to a new design that is aesthetically pleasing and suitable for industrial applications, based on the overall or partial shape, pattern, or their combination, as well as the combination of color, shape, and pattern of a product.
An invention patent refers to a new technical solution proposed for a product, method, or improvement thereof.
A utility model patent refers to a new technical solution proposed for the shape, structure, or combination of a product that is suitable for practical use. In the Patent Law, the requirements for creativity and technical level of utility models are lower than those of invention patents, but they have greater practical value. In this sense, utility models are sometimes referred to as small inventions or small patents.
(1) Invention: the description and illustrations of the patent, with accompanied drawings if appropriate, the abstract, and the drawing accompanying the abstract if appropriate;
(2) Utility model: the description and illustrations of the patent, with accompanied drawings, the abstract, and the drawing accompanying the abstract;
(3) Design: the pictures or photographs of the design, and brief explanation of the design.
